Effect of CHIP Expansion on Employer Health Plans

Congress has recently expanded the Children's Health Insurance Program ("CHIP") in ways that will affect all employer-sponsored health plans as of April 1, 2009.  Plans will have to honor two new "special enrollment" events, and they will have to pay benefits on a primary basis when a covered individual also has CHIP coverage.  In addition to amending their health plans to reflect these new CHIP requirements, employers may want to make conforming changes to their cafeteria plan documents.  Eventually, this CHIP expansion will also impose new notification and reporting requirements.  This webinar will address all of these new requirements, with particular emphasis on those taking effect as of April 1.

Kenneth A. Mason, Partner - Spencer Fane Britt & Browne LLP
Ken, a partner with the firm, heads the Employee Benefits Group. He concentrates on ERISA and other aspects of employee benefits law, including both tax and fiduciary issues, substantial involvement with retirement and welfare plans, executive deferred compensation, federal employment discrimination statutes, and issues unique to governmental and other tax-exempt employers. He clerked for U.S. District Judge Earl E. O'Connor before joining Spencer Fane.

Ken is a Past-Chair of both the Employee Benefits Committee of the Kansas City Metropolitan Bar Association and the Employee Benefits Institute of Kansas City. He has been on the faculty of the American Bankers Association National Retirement Trust School and is listed in The Best Lawyers in America.

Ken's lecture subjects have included executive deferred compensation, 401(k) nondiscrimination testing, COBRA compliance, benefit plan aspects of the Americans with Disabilities Act, employee leave-sharing programs, and long-term care insurance.

He has published several articles, including "Automatic Enrollment: The New Norm," "Leave-Sharing Programs: Everything Doesn't Go," "New COBRA Regulations: Good News for Plan Sponsors and Administrators," "Trends in ADA Litigation Affecting Employee Benefit Plans," "Should a Tax-Exempt Employer Adopt a Section 401(k) Plan?" "Deferred Compensation Strategies for Executives of Tax-Exempt Employers," and "The Source Tax Law: Issues for Employers and Practitioners."

   
 

Lawrence Jenab, Associate - Spencer Fane Britt & Browne LLP
Larry is an associate in our Employee Benefits and ERISA Litigation groups. His practice emphasizes ERISA and other aspects of employee benefits law, including tax and fiduciary matters. He also has experience successfully litigating complex ERISA preemption and standing issues.

Larry received his Master's Degree with Honors and his juris doctor from the University of Kansas, where he was Editor in Chief of the Kansas Law Review. He received the C.C. Stewart Award for graduating first in his class and is a member of Phi Beta Kappa and the Order of the Coif.

Before joining Spencer Fane, Larry served as law clerk to the Honorable Deanell Reece Tacha, Chief Judge of the U.S. Court of Appeals, Tenth Circuit, and as Lecturer in Law at the University of Kansas, where he taught Civil Procedure. Larry also worked for the Japanese Ministry of Education, serving in Miyazaki Prefecture, where he taught high school English. He also attended the Musician's Institute in Hollywood, California, where he studied guitar performance.

Larry's recent lecture topics include employee wellness programs and ERISA health-plan reimbursement actions.
